What if I was partially at fault for the accident?
Texas follows a rule called modified comparative negligence. You can still recover damages as long as you were less than 51% at fault for the accident. However, your compensation will be reduced by your percentage of fault. For example, if you are awarded $100,000 but found to be 20% at fault, you will receive $80,000.
